This paper outlines a constructivist approach to environmental ethics which attempts to reconcile realism in the ontological sense, i.e., the view that there is an objective material world existing outside of human consciousness, with the view that how nature is understood and acted in are epistemologically and morally constructed. It is argued that while knowledge and ethics are indeed culturally variable, social constructions of nature are nonetheless constrained by how things actually stand in the world. The 'realist' version of constructivism (...) proposed here can be linked to dialectical forms of reasoning which see knowledge and ethics as arising out of human interactions with an objectively real environment, and contrasted with strong constructivist views which see nature as 'nothing more than' a social construct. While both the physical environment and human attitudes towards it are in part socially constructed, nature also retains a measure of autonomy, or 'wildness', apart from human constructions. Although nonhuman entities are indeed incapable of entering into contractual relations with humans or of participating in social dialogue on ethical norms, they can nonetheless become the objects of moral consideration on the part of humans. Moral consideration need not be extended universally to all nonnatural entities, but only to those entities with which humans interact. Rather than regard some or all of the natural world as having “intrinsic value,” considered judgments must be made regarding which parts of nature can (...) be legitimately used for human purposes and which should be left alone. What needs to be justified are not attempts to preserve nature but rather any human interventions which infringe on the autonomy of nature. (shrink)

From the Introduction: This inquiry is concerned with the themes of praxis and action in four philosophic movements: Marxism, existentialism, pragmatism, and analytic philosophy. It is rare that these four movements are considered in a single inquiry, for there are profound differences of emphasis, focus, terminology, and approach represented by these styles of thought. Many philosophers believe that similarities among these movements are superficial and that a close examination of them will reveal only hopelessly unbridgeable cleavages. While respecting the genuine (...) fundamental differences of these movements, this inquiry is undertaken in the spirit of showing that there are important common themes and motifs in what first appears to be a chaotic babble of voices. I intend to show that the concern with man as an agent has been a primary focal point of each of these movements and further that each contributes something permanent and important to our understanding of the nature and context of human activity. Organ transplantation remains one of modern medicine's remarkable achievements. It saves lives, improves quality of life, diminishes healthcare expenditures in end-stage renal patients, and enjoys high success rates. Yet the promise of transplantation is substantially compromised by the scarcity of organs. The gap between the number of patients on waiting lists and the number of available organs continues to grow. As of January 2006, the combined waiting list for all organs in the United States was 90,284. Unfortunately, thousands of potential (...) organs are lost each year, primarily due to lack of consent to donation from the deceased before death, or from the family thereafter. Only fifty percent of potential donors – the “conversion” rate – become actual donors. The costs attributed to organ shortage are substantial – Medicare paid over $15.5 billion in 2002 for treating patients with end-stage renal-disease, who predominate on organ waiting lists. (shrink)

Regan's new translation of texts from Thomas Aquinas' _Summa Theologica_ II–II--on the virtues prudence, justice, fortitude, and temperance--combines accuracy with an accessibility unmatched by previous presentations of these texts. While remaining true to Aquinas' Latin and preserving a question-and-answer format, the translation judiciously omits references and citations unessential to the primary argument. Jan Assmann, one of the world’s most outstanding Egyptologists, has written a remarkable and fascinating book, Moses the Egyptian: The Memory of Egypt in Western Monotheism. Assmann, however, is not primarily concerned with the historical question that has intrigued thinkers throughout the ages : Was Moses an Egyptian? Nor is the book primarily a contribution to Egyptology—although Assmann is a master of the discipline. What then is it really about? The question is simple and direct, but the answer—as we shall (...) see—is complex and subtle. Assmann’s primary aim is to contribute to a new field of study that he calls “mnemohistory.” Moses, Assmann tells us, is a “figure of memory, not of history.” There is no independent historical or archaeological evidence that the biblical Moses ever really existed. Our knowledge of Moses is based primarily on the biblical account, although there are also legends, stories, and anecdotes that can be found in apocryphal sources. Yet there is no other human figure of memory that has exerted such a powerful influence in shaping the tradition of Western monotheism. Assmann explores the image of Egypt in Western thinking; he probes the dynamics of religious intolerance and tolerance, and the origins of anti-Semitism. He also contributes to an enriched understanding of the Enlightenment and its legacy. What is the good for human persons? If I am trying to lead the best possible life I could lead, not the morally best life, but the life that is best for me, what exactly am I seeking?This phrasing of the question I will be pursuing may sound tendentious, so some explanation is needed. What is good for one person, we ordinarily suppose, can conflict with what is good for other persons and with what is required by morality. A prudent (...) person seeks her own good efficiently; she selects the best available means to her good. If we call the value that a person seeks when she is being prudent “prudential value,” then an alternative rendering of the question to be addressed in this essay is “What is prudential value?” We can also say that an individual flourishes or has a life high in well-being when her life is high in prudential value. Of course, these common-sense appearances that the good for an individual, the good for other persons, and the requirements of morality often are in conflict might be deceiving. For all that I have said here, the correct theory of individual good might yield the result that sacrificing oneself for the sake of other people or for the sake of a morally worthy cause can never occur, because helping others and being moral always maximize one's own good. But this would be the surprising result of a theory, not something we should presuppose at the start of inquiry. When a friend has a baby and I express a conventional wish that the child have a good life, I mean a life that is good for the child, not a life that merely helps others or merely respects the constraints of morality. After all, a life that is altruistic and perfectly moral, we suppose, could be a life that is pure hell for the person who lives it—a succession of horrible headaches marked by no achievements or attainments of anything worthwhile and ending in agonizing death at a young age. So the question remains, what constitutes a life that is good for the person who is living it? (shrink)

At present, there is an enormous gulf between the visibility of evil and the paucity of our intellectual resources for coming to grips with it. We have been flooded with images of death camps, terrorist attacks and horrendous human suffering. Yet when we ask what we mean by radical evil and how we are to account for it, we seem to be at a loss for proper responses. Bernstein seeks to discover what we can learn about the meaning of evil (...) and human responsibility. He turns to philosophers such as Kant, who coined the expression 'radical evil', as well as to Hegel and Schelling. He also examines more recent explorations of evil, namely the thinking of Freud and Nietzsche on the moral psychology of evil. Finally, he looks at the way in which three post-Holocaust thinkers - Emmanuel Levinas, Hans Jonas, and Hannah Arendt - have sought to come to grips with evil "after Auschwitz." Bernstein's primary concern throughout this challenging book is to enrich and deepen our understanding of evil in the contemporary world, and to emphasize the vigilance and personal responsibility required for combating it. Most individuals realise that we have a moral obligation to avoid the evils of war. But this realization raises a host of difficult questions when we, as responsible individuals, witness harrowing injustices such as ""ethnic cleansing"" in Bosnia or starvation in Somalia. With millions of lives at stake, is war ever justified? And, if so, for what purpose? In this book, Richard J. Regan confronts these controversial questions by first considering the basic principles of just-war theory and then applying (...) those principles to historical and ongoing conflicts. Part One presents two opposing viewpoints: first, that war is not subject to moral norms and, second, that war is never morally permissible. The author rejects both perspectives, and moves to define the principles of just-war theory. He evaluates the roles of the president, Congress and, most importantly, the UN Security Council in determining when long-term US military involvement is justified. The moral limits of war conduct and the moral problem of using, or threatening to use, nuclear weapons are also discussed. On the just cause to wage war, Regan argues that defense of nations and nationals - whether in self-defense or in defense of others - remains the ""only"" classical cause that in the modern world would justify resorting to war. With respect to military intervention in secessionist and revolutionary wars, he contends that such intervention might be justified, but that prudence dictates extreme caution. In considering acceptable war conduct, Regan elaborates the specific principle of discrimination and proportionality; he maintains that civilians uninvolved in the enemy's war should not be directly targeted and that the costs of military action must be proportionate to the anticipated benefits of destroying military targets. The second part of the book presents case studies of eight historical wars - World War I, the Vietnam War, the Falklands War, the revolution and civil war in Nicaragua, the civil war in El Salvador, the Gulf War, the intervention in Somalia, and the Bosnian War - and poses several provocative questions about each. It invites readers and students to apply just-war principles to complex war-related situations and to understand the factual contingencies involved in moral judgements about war decisions. The book should be of particular interest to students of the moral issues of international relations and to readers interested more generally in philosophy, theology and political science. (shrink)
